Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the In Their Words website, SMS service, and related offerings (the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Who can use the Service

You must be at least 18 years old and able to form a binding contract to use the Service as a paying Subscriber. You are responsible for ensuring that any person you enroll as a Recipient knows about and consents to receiving messages from us. By enrolling a Recipient, you represent that you have their permission to provide their phone number to us for the purpose of receiving SMS messages from the Service.

2. Accounts

You are responsible for keeping your login credentials secure and for all activity under your account. Notify us immediately if you suspect unauthorized access.

3. Subscription, billing, and cancellation

  • The Service is offered on a recurring subscription basis. Current pricing is shown on the pricing page and may change with notice.
  • Payment is processed by Stripe. You authorize us to charge your chosen payment method on each billing cycle until you cancel.
  • You may cancel at any time from your dashboard. Cancellation takes effect at the end of your current billing period. We do not provide prorated refunds for partial periods, except where required by law.
  • If a payment fails, we may pause outbound messages until your billing is restored.

4. SMS messaging terms

By enrolling a Recipient, you confirm that you have their permission to receive SMS messages from In Their Words. No messages are sent to a Recipient until they reply YES to our opt-in message. Recipients may reply STOP, QUIT, CANCEL, or UNSUBSCRIBE at any time to stop all messages, or HELP for assistance. Message and data rates may apply. Message frequency varies.

You agree not to use the Service to send unsolicited messages, to harass any person, or to enroll anyone without their knowledge and consent. Violations may result in immediate termination of your account.

5. Your content

Messages sent and received through the Service (“Content”) belong to you and the Recipient. By using the Service, you grant us a limited, non-exclusive license to store, process, and display Content solely to operate the Service (including sending Content to our subprocessors as described in our Privacy Policy). We will not sell Content or use it to train third-party AI models.

You are responsible for the Content you and your Recipients send. Do not use the Service to transmit unlawful, harmful, threatening, abusive, or otherwise objectionable material.

6. Acceptable use

You agree not to:

  • Use the Service in violation of any law or regulation, including TCPA, CAN-SPAM, and similar statutes.
  • Enroll any phone number without the owner's explicit permission.
  • Attempt to gain unauthorized access to the Service, other accounts, or related systems.
  • Reverse-engineer, scrape, or interfere with the Service.
  • Resell or sublicense the Service without our written permission.

7. Third-party services

The Service relies on third-party providers (Twilio, Stripe, Supabase, Anthropic, Resend, PostHog, Sentry, and Render). Their availability and terms affect the Service. We are not responsible for the actions or outages of third parties.

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE OPERATION, AND WE DO NOT GUARANTEE THAT ANY PARTICULAR MESSAGE WILL BE DELIVERED.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN THEIR WORDS AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, REVENUE, OR PROFITS, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR (B) $100.

10. Indemnification

You agree to indemnify and hold harmless In Their Words from any claim, loss, or expense (including reasonable attorneys' fees) arising from your use of the Service, your Content, or your violation of these Terms — including claims that you enrolled a Recipient without their consent.

11. Termination

We may suspend or terminate your account at any time for violation of these Terms, for non-payment, or to comply with legal obligations. You may stop using the Service and cancel your subscription at any time.

12. Changes to the Terms

We may update these Terms from time to time. Material changes will be announced by email or in the dashboard. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.

13. Governing law

These Terms are governed by the laws of the State of Delaware (USA), without regard to its conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Delaware, and you consent to their jurisdiction.
